(Oral) In the order dated 01.02.2023, it was observed by the Coordinate Bench about learned counsel, who was representing the appellant to have passed away and thereupon, notice was ordered to be issued to the appellant. Even, as per office report, notice sent for service of the appellant has been received back with the report that he has died. In the given circumstances, there is no one to pursue the appeal and as such, the same is hereby dismissed for want of prosecution, however, with the revival clause, as and when anybody comes forth to assert the claim qua the appellant, who has since died.
