Mr. Munish Mittal, Advocate for the petitioner. HARINDER SINGH SIDHU, J Prayer is for grant of anticipatory bail in case FIR No.554 dated 04.06.2020 under Section 379-A IPC registered at P.S Jagadhri City, District Yamuna Nagar.

Allegations against the petitioner are that he along with his coaccused had snatched the bag containing one mobile phone mark Vivo along with Jio Sim card and certain necessary documents besides Rs.1500/- from the complainant.

The petitioner was admitted to bail by the learned Addl. Sessions Judge, Jagadhri on 18.09.2020. However, due to absence of the petitioner on one of the dates i.e 15.12.2020 as fixed by the learned trial Court, bail bonds and surety bonds of the petitioner were cancelled and his presence has been ordered to be secured through non-bailable warrants. Learned counsel for the petitioner states that his nonappearance was not intentional. In fact, the petitioner was present in the court complex on 15.12.2020 but because of being informed/assured by his counsel that due to COVID-19, all the cases have been adjourned and he would be informed of the next date accordingly, he could not cause his MANOJ KUMAR 2021.01.21 18:40 I attest to the accuracy and integrity of this document

CRM-M-2722 of 2021 #2# appearance on the date fixed. He states that the next date fixed before the trial Court is 25.01.2021. He undertakes that the petitioner shall appear before the learned trial Court on the date fixed or any date to be fixed by this Court.

Having heard learned counsel for the parties and taking into account the facts of the present case, this petition is disposed of with the observation that the petitioner may appear before the learned trial Court on the date fixed i.e 25.01.2021. On his doing so, he shall be enlarged on bail by the trial Court subject to his furnishing bail bonds and surety bonds to its satisfaction. He shall also file an undertaking before the concerned Court to continue appearing as and when required apart from following all the terms and conditions fixed in this respect.

This shall, however, subject to the petitioner depositing a sum of Rs.5000/- with the Poor Patients' Welfare Fund of the Postgraduate Institute of Medical Education and Research (PGIMER), Chandigarh.
