In FIR bearing No. 180 of 8.12.2020, registered at Police Station Bahawala, Tehsil Abohar, District Fazilka, the offences constituted under Sections 324, 323, 341, 506, 148, 149, and, later on added Section 326 IPC, are embodied.

The learned State counsel, on instructions, given to him by ASI Lakhwinder Singh, submits that the recovery of weapon of offence, i.e. gandasa, has been effectuated, at the instance of the bail petitioner, to the investigating officer concerned. He further submits that the petitioner has joined investigations, and, is no longer required for any custodial interrogation. It is also stated by the learned State counsel, on instructions given to him, that the victim has fully recuperated from the injury, and, that he is also discharged from the hospital 3.

Therefore, this Court does not deem it fit, and, appropriate to order for the custodial interrogation of the petitioner, as it would GURPREET SINGH 2022.03.30 17:50 I attest to the accuracy and authenticity of this document Chandigarh unnecessarily fetter, and, curtail his personal liberty.

Consequently, the instant petition is allowed, and, the order made by this Court on 17.1.2022, is made absolute on the same terms and conditions.

The afore observations are meant only for the disposal of the present petition, and, shall not affect the merits of the trial arising from the FIR (supra).
