**** RITU BAHRI , J. (Oral) Petitioner is seeking issuance of direction to the respondents to adjust/reinstate her on the post of Statistical Assistant in the department of Welfare of Schedule Caste and Backward Classes.

The petitioner was relieved, vide letter dated 14.06.2018 (P-6) and thereafter, one regularly selected candidate joined on her place. But the grievance of the petitioner is that the regularly selected candidate also resigned from the post and thus the petitioner can be adjusted on that post again. A legal notice has also been given by the petitioner in this regard on 09.09.2019 (P-9). The present petition is liable to be dismissed as it is upon the department to give appointment to any candidate or not, if there is no workload in the department, the department cannot be forced to take the petitioner back in service. It is not the case of the petitioner that he has been replaced by any other contractual employee. At this stage, no direction can be issued to the respondents to adjust/reinstate the petitioner on the post of Statistical Assistant. Disposed of.

However, the petitioner is at liberty to approach this Court , if so advised as and when cause of action arise.
