Learned counsel for petitioner submits that the Executing Court is proceeding further to execute the ejectment order despite the fact that curative petition has been filed in the Hon'ble Apex Court. Petitioner was ordered to be ejected vide order dated 15.10.2014 by learned Rent Controller, Patiala. He filed appeal against that order, which was dismissed vide order dated 16.11.2015. Revision petition filed in this Court was also dismissed vide order dated 11.07.2016. Petitioner then approached the Hon'ble Apex Court but could not succeed and SLP filed by them was also dismissed vide order dated 19.09.2016. This did not deter the petitioner from pursuing the matter further and they filed review petition before Hon'ble Apex Court, which was also dismissed on 31.01.2017. Now curative petition is stated to have been filed before Hon'ble Apex Court in which there is no stay of execution of the ejectment order.

In these facts and circumstances, the Executing Court is rightly proceeding further to execute the ejectment order against the petitioner. I Jitender Kumar 2018.02.23 15:56 I attest to the accuracy and integrity of this document Chandigarh
