Seeking quashing of order dated 12.07.2019 passed by the PCS, SDJM, Nakodar in complaint case No.COMI-35-2016, petitioner has come up before this Court by filing the present petition under Section 482 CrPC. 2.

Mr. Varender Pal Singh Mithewal, Advocate has filed his power of attorney, which is taken on record and put in appearance on behalf of the respondent and submits that respondent-Gurbachan Singh has expired. He further submits that present petition rendered infructuous as complainant stand expired and until his legal heirs are permitted to pursue or complaint converted into state case after framing of charges, present petition is not maintainable.

Given above, the present petition is disposed of as infructuous with liberty to petitioner to file fresh if any adverse order after the death of complainant is passed.
