The contempt petition has been filed for deliberate and intentional disobedience of decree dated 08.09.2022 passed in HMA'971' 2022.

Learned counsel for the petitioner contends that divorce under Section 13'B of the Hindu Marriage Act, 1955 was granted on the conditions of Memorandum of Understanding dated 21.07.2021, which is not complied with by the respondent.

Per contra, learned counsel for respondent contends that even the petitioner is not complying with the conditions of Memorandum of Understanding dated 21.07.2021. He further contends that respondent has moved an application under Section 26 of the Hindu Marriage Act, 1955 for modification of visitation rights in Memorandum of Understanding. 4.

Since conditions of Memorandum of Understanding dated 21.07.2021, in view of which divorce under Section 13'B of the Hindu Marriage Act, 1955 was granted vide decree dated 08.09.2022 passed by MOHD AYUB 2025.08.28 10:54 I attest to the accuracy and authenticity of this order/judgment.

  learned Family Court, Gurugram in HMA'971'2022 is not complied with by both the parties and the respondent has already filed an application under Section 26 of the Hindu Marriage Act, 1955 for modification of Memorandum of Understanding, therefore, as on date no contempt is made out.
