Notice of this petition was issued to the respondent after it was noticed that Sh. P.N.Makani, Advocate who was representing the respondent, has since passed away. As per office report, notice issued to the respondent has been received back with the report that she is not residing at the given address. It was informed on 15.01.2019 that the respondent sold the house in question by way of a registered sale-deed dated 14.02.2006. The petitioner was directed to file a specific affidavit with complete details as to the person to whom rent/mesne profits was being paid by the petitioner. CR No.2742 of 2004(O&M) [2] also sought time to furnish the fresh address of the respondent. Despite opportunity, affidavit of the petitioner is not forthcoming neither is the fresh address of the respondent being furnished. Today, learned counsel for the petitioner submits that despite intimation to the petitioner, there has been no response and he pleads no instructions in this case. This Court is left with no other alternate, but to dismiss the present revision petition for non-prosecution. Ordered accordingly. ( LISA GILL ) February 27 , 2019.
