CRM-M-2588-2024 Date of Decision: 19.01.2024 Stalian Jeet

...Petitioner

Versus

State of Haryana

...Respondent

CORAM:

HON'BLE MR. JUSTICE ANOOP CHITKARA

Present:

Mr. Kshitij Sharma, Advocate for the petitioner.

Mr. Vikrant Pamboo, Sr. D.A.G., Haryana.

**** ANOOP CHITKARA, J.

FIR No. Dated Police Station Sections 21 13.05.2023 Anti Corruption Bureau, Gurugram 409, 420, 120-B, 467, 468, 471, 201 IPC and 7, 8, 13 (1) r/w 13(2) of PC Act, 1988 Seeking quashing/modification of order dated 08.01.2024 passed by Additional Sessions Judge, Rewari in the FIR captioned above whereby conditions imposed were onerous, harsh, unconscionable and incapable of being complied with by the petitioner, the petitioner has come up before this Court under Section 482 Cr.P.C. 2.

The limited question for which the petitioner has come up before this Court is his financial incapacity to make a deposit of Rs.25 lacs in terms of order vide which he was permitted to travel to Canada.

3.

Counsel for the petitioner voluntarily submits that at the most, he would be depositing an amount of Rs.15 lacs and he requests this Court to reduce the amount to Rs.15 lacs. The State has no reason to oppose such a prayer. He further submits that due to non-availability of flights directly to Canada, he be permitted to enter Canada through USA or any other country.

4.

The nature of order which this Court proposes to pass, there is no necessity of calling any response from the State. 5.

The amount is reduced from Rs.25 lacs to Rs.15 lacs. Needless to say that in case the petitioner finds better flights to enter Canada through any other country, he may do so.

6.

Petition stands allowed with the aforesaid observations. Pending applications, if any, stand disposed of.
