**** RAJ MOHAN SINGH, J. (Oral) Perusal of the record would show that this case was dismissed vide order dated 01.02.2019. Thereafter the case was restored and notice of motion was issued vide order dated 24.05.2019. Keeping in view the claim of Rs.1,63,904/-, at one point of time, the matter was sought to be referred to the Mediation and Conciliation Centre of this Court vide order dated 17.02.2020, but later on learned counsel for the respondent made a statement that possibility of amicable resolution of the dispute was bleak. Thereafter, the matter was adjourned for arguments.

ARB-26-2019 (O&M) In view of reply filed by the respondent, an objection has been taken that the sole Arbitrator has already announced the award on 15.10.2019 in Arbitration No.3/2019. Though the award was passed ex parte, but the applicant had a legal remedy to challenge the award in question.
According to learned counsel for the respondent, the said award has not been challenged so far.
In view of aforesaid no indulgence is warranted in this case. The petition stands dismissed.
The petitioner, if so, advised may avail his legal remedies in accordance with law.
