There is no error in the order passed by the trial Court finding an application brought at the instance of purchasers from the defendants as maintainable. A purchaser will have the same remedy of what is vendor had. If it were to be contended that there was no ground for setting aside an ex parte decree that should be a different matter for consideration and it has nothing to do with the maintainability of the petition itself. The lower Court allowing the maintainability of the application has committed no wrong and the petitioner cannot treat himself as aggrieved person to come before this Court complaining in a revision petition. The application for setting aside decree at the instance of the purchasers will be considered on merits on the grounds which are set forth by the trial Court.
