It is apparent that the application was moved after the evidence of the plaintiff was over and even the defendant himself had been examined. The amendment sought is only to take up the objection that the disputed agreement to sell was not a registered document. The learned trial Court has noticed that the fact of non-registration of agreement to sell is an admitted fact and not denied by the other party and therefore, the application was aimed at only to prolong the proceedings.
After making submissions at length, learned counsel seeks permission to withdraw the present revision petition. Dismissed as withdrawn.
