The prayer for consequential relief is good enought for the plaintiff to be required to pay the ad valorem court fee on the sale consideration of the property. If the plaintiff has sought for assailing a decree and sale that has been effected, notwithstanding the fact that he was himself not party to the sale deed, the fact that the plaintiff is seeking for recovery of possession is the justification for requirement of court fee by application of Section 7(v) of the Court Fee Act. 2.
The order already passed is sustained and the civil revision is dismissed.
