NIRMALJIT KAUR, J. (ORAL) After arguing at length and after this Court had pronounced the order of dismissal but, before the Court proceeded to dictate the order in detail, learned counsel for the petitioners on instructions from the petitioners, namely, Satpal and Raj Kumar, who are both present in the Court, states that petitioners may be granted one year to vacate the premises with a further undertaking before this Court that they shall give an undertaking even before the learned Rent Controller that they shall vacate the premises on or before 30.09.2020 and shall also pay `6,000/- per month to respondent from today onwards till the date of the handing over the vacant possession.
Respondent No.1-Surinder Mohan Rehan, who is also present in Court has no objection to the grant of time subject to his undertaking that
CR-1358-2017(O&M) -2they will vacate the premises by 30.09.2020. In view of the above, the present revision petition is disposed of with the following directions:- "(a) the petitioners shall give an undertaking before the Rent Controller within two weeks from today, i.e. 14.10.2019 that they shall hand over the vacant possession on or before 30.09.2020.
(b) they shall also give an undertaking that they will pay `6,000/- per month from today onwards till the date of the handing over the vacant possession. In case they do not give this undertaking by 14.10.2019, the respondents-landlord shall be at liberty to initiate execution proceedings and proceed accordingly. The respondents-landlord will also be at liberty to avail the remedy of contempt.
(c ) the petitioners-tenant shall pay `6,000/- per month regularly, i.e. by 7th of each month in the account of respondent-landlord- Surinder Mohan Rehan, A/c No.10760897689, SBI Bank Shahbad (Markanda), having IFSC Code:SBIN0002481.
(d) In case the petitioners do not vacate the premises by 30.09.2020, then too the respondents-landlord shall proceed to file eviction petition as well as avail the remedy of contempt." Disposed of as above.
