Mr. Nakul Sharma, Advocate for the petitioner. RAJESH BINDAL, J The petitioner-plaintiff has filed the present petition impugning the order dated 3.1.2015, whereby the evidence of the plaintiff has been closed by order of the court.

In the case in hand, the suit was filed by the petitioner-plaintiff for injunction on 12.5.2010. After completion of pleadings, the issues were framed on 21.4.2011. Vide impugned order dated 3.1.2015 after granting 16 opportunities to the petitioner-plaintiff for conclusion of his evidence, the same was closed by the order of the court.

Learned counsel for the petitioner submitted that the petitioner has filed his affidavit for examination-in-chief on 3.4.2013, however, he did not appear for his cross-examination for nearly two years. Considering the aforesaid facts, I do not find this to be a fit case for grant of further opportunity to the petitioner-plaintiff for his evidence. Dismissed.
