******* SURINDER GUPTA, J.(Oral) After arguing for some time, learned counsel for the petitioner, on instructions from the petitioner, who is stated to be present in Court, seeks permission to withdraw this petition with prayer that petitioner be allowed reasonable time for vacating and handing over the possession of the demised premises to the respondent-landlord. In view of submission of learned counsel for the petitioner, this petition is dismissed as withdrawn. To facilitate the revision petitioner to find alternate accommodation, he is allowed time upto 31.12.2018 to vacate and hand over the vacant possession of the demised premises to the respondent-landlord, subject to the following terms:- (i) Revision petitioner(s) shall deposit entire arrears of rent upto the date of order of Appellate Authority and mesne profits @ `3000/- per Sachin Mehta 2018.03.07 14:41 I attest to the accuracy and authenticity of this document HIGH COURT, CHANDIGARH
CR-1331-2018 -2month from the date of order passed by the Appellate Authority upto 31st March, 2018, within three weeks.
(ii) He will keep on paying/depositing the mesne profits of subsequent months upto 31.12.2018 on or before 10th day of each month. (iii) He will file affidavit before the Executing Court within four weeks giving details of entire payment of rent/mesne profits and undertaking to vacate and hand over the vacant possession of the demised premises to the respondent on or before 31.12.2018. In case of default in compliance of any of the above terms, the respondent-landlord will be entitled to execute the order of ejectment forthwith.
The order has been passed in the absence of respondent to avoid unnecessary delay and expenses. A copy of this order be conveyed to the respondent. In the event of having any objection, respondent may file application to that effect. On receipt of the application, the same be listed for hearing.
