Learned counsel for the petitioner contends that the petitioner, who is working as Accountancy and Auditing Instructor in the Department since 30.11.2002, has been given first ACP scale with effect from 01.01.2016 vide order dated 24.07.2018, whereas he is entitled to the same Seema 2025.01.21 16:14 I attest to the accuracy and integrity of this document


    with effect from 01.01.2013. He further contends that similarly placed employees in the Department have been given the benefit with effect from 01.01.2013 vide office order dated 13.09.2017, Annexure P-2. The respondents' action in not giving first ACP scale to the petitioner with effect from the same date is, therefore, discriminatory. 3.

As per facts apparent on record, thef petitioner was given the first ACP scale on completion of eight years' regular satisfactory service with effect from 01.01.2016, vide order dated 24.07.2018. The order was not challenged by the petitioner. Merely because he has been making representations against the same, as mentioned in the petition, it will not give rise to a fresh cause of action to approach this Court. The petition, which has been filed after inordinate delay of about six years, suffers from delay and laches, and cannot be entertained.
