In the present Regular Second Appeal, the plaintiff-appellant is challenging the judgment and decree dated 18.10.2022 passed by the First Appellate Court, along with the judgment and decree dated 24.02.2021 passed by the trial Court, whereby his civil suit as well as the first appeal have been dismissed.

Mr. Madhur Singh, Advocate, has put in appearance on behalf of respondent Nos.1 and 2 and has filed his Power of Attorney, which is taken on record.

At the outset, learned counsel for respondent Nos.1 and 2 has submitted that the question of law involved in the present appeal as to whether jurisdiction of the Civil Court is barred in view of Section 145 of the Electricity Act, 2003, has since been decided by the Hon'ble Division Bench of this Court vide judgment dated 14.05.2025 passed in Mahesh Kumar Versus Sub Divisional Officer and another, reported in 2025(3) RCR (Civil) 303.

Faced with the same, learned counsel for the plaintiff-appellant seeks permission to withdraw the present appeal as well as his civil suit itself with liberty to avail the remedies as available in law. 5.
Dismissed as withdrawn with liberty aforesaid. 6.
It is made clear that any evidence recorded/observations made in the impugned judgments and decree would not operate as res judicata in any subsequent proceedings initiated by the plaintiff-appellant. 7.
