The petitioner who is a purchaser of the suit property from the plaintiff during the pendency of the suit sought for impleadment as assignee of the plaintiff's interest. The petition filed under Order 22 Rule 10 CPC was dismissed. In my view, the order is untenable and it is set aside. The petitioner is brought on record as subsequent assignee of the 2nd plaintiff. He will be substituted for the existing plaintiff and will be at liberty to prosecute the suit.

The civil revision petition is allowed.
