The petitioner, incarcerating upon his arrest in the FIR captioned above, came up before this Court under Section 439 of Code of Criminal Procedure, 1973 (CrPC) seeking bail.

In paragraph No.17 of the bail petition, the petitioner declares that no case is pending against her. However, it is further clarified that the State would be in best position to give particulars regarding criminal history against the petitioner. 3.

The above statement that the State would give better particulars, is absolutely not acceptable because it is for the petitioner's counsel to know about criminal history of the petitioner. Further as per para 9 of the reply filed by the concerned Deputy Superintendent of Police, the petitioner has the criminal history which she has concealed from the Court, which is as under:- Sr. No.

Given the fact that the case which is pending against the petitioner is under Section 22 of NDPS Act, the present petition is dismissed for not declaring the proper particulars.
