The petition for amendment in the plaint is resisted by the respondent-defendant that the amendment carried out is belated and further it does not also relate to the suit property. According to him, the measurements given in the sale deed have no relevance to the measurements for the property which is in dispute. These contentions should be brought by the respondent by way of amendment in the written statement consequent amendment ordered in favour of the plaintiff or by means of an additional written statement as contemplated under Order 8 Rule 9 CPC.
