Mr. Rakesh K Kaundal, Advocate for petitioner Mr. RKS Brar, Addl. AG Haryana **** SURYA KANT, J. (Oral) (1) The petitioners have laid challenge to the auction conducted by the Rehabilitation Department in respect of the land in dispute. The claim was that the land in dispute is a shamlat deh and he was in possession thereof hence the Rehabilitation Department is not competent to auction the same.

(2) Mr. RKS Brar, learned Addl. AG Haryana states that as per the information given to him, the petitioners are no longer in possession of the subject-land. The aforesaid plea is duly supported by the private respondents. Learned counsel for the petitioner is unable to refute the above-stated stand.

(3) In the light of these subsequent events, namely, the petitioners are no longer in possession of the suit property, we are of the view that the writ petition has become infructuous and is disposed of accordingly.
