There is no cause for the petitioner to be complaining about the fact that there was a permission granted by this Court in C.R. No.293 of 2014 to the defendants Pinki and Sangeeta to file the written statements and the permission now granted by the trial Court is to Sangeeta alone to file a written statement. If there are two written statements by the same party, the Court will elicit from the 2nd defendant Sangeeta as to which statement she seeks to rely on and exercise the right of election before the trial Court. The Court will take on record the statement which the 2nd defendant elects to retain as a defence in the suit.
