...Respondent(s)

CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA

Present:

Mr. Jasbir Singh, Advocate, for the applicant-petitioner.

Mr. Santosh Sharma, Advocate, for the respondents.

G.S.SANDHAWALIA, J. (Oral) C.M. No. 5894-CII of 2017 in C.R. No. 1464 of 2017 Mr. Dadwal, counsel for the respondents submits that in view of the order dated 08.03.2017, possession has been handed over with the help of the police. The conduct of the present petitioner has already been deprecated vide the above said order.

Mr. Jasbir Singh, counsel for the petitioner submits that some articles/goods like temporary shed of iron rods which were set up are still lying in the premises and seeks the custody of the same. The same is opposed by Mr. Dadwal on the ground that the property has been damaged intentionally at the time of vacation and considerable amount would have to be spent on restoration. Photographs also have been shown to this Court regarding the damage caused to the property.

Keeping in view the conduct of the petitioner and the fact that this Court is not further inclined to take further action against her since Shivani Gupta 2017.03.24 12:36 I attest to the accuracy and integrity of this document Chandigarh

-2possession now has been handed over to the landlady, the request as such in the present application is declined and the application is dismissed. C.R. No. 1464 of 2017 In view of the observation made in C.M. No. 5894-CII of 2017, the present civil revision also stands disposed of as having been rendered infructuous. It is, however, made clear that the disposal of the present revision petition would not bar the landlady from initiating due process to recover the arrears of rent.
