Petitioners have filed this petition under Article 227 of Constitution of India challenging the order dated 7.2.2013 (Annexure P-2) and order Annexure P-5.

Petitioners have filed suit for declaration to the effect that they were owners in possession of the suit land. Respondents No. 1 and 2 were impleaded as defendants No. 1 and 2. During the pendency of the suit, an application was filed by respondents No. 3 to 5 under Order 1 Rule 10 of the Code of Civil Procedure, 1908 for being impleaded as defendants in the suit.

Learned counsel for the petitioners has submitted that the petitioners have no objection qua the impleading of respondents No. 3 and 4 as defendants in the suit but respondent GURPREET SINGH 2015.05.06 12:21 I attest to the accuracy and authenticity of this document Chandigarh

Civil Revision No. 1627 of 2014 -2No. 5 Balwinder Singh cannot be impleaded as a defendant as he is not the son of Inder Singh.

Learned counsel for respondents No. 3 to 5 has submitted that although, Balwinder Singh is the son of Inder Singh, but he has no objection if the name of Balwinder Singh is deleted from the array of parties as it is unnecessarily delaying the decision of the suit.

In view of the submission made by learned counsel for respondents No. 3 to 5, this petition is disposed of with a direction that name of Balwinder Singh respondent No. 5 is ordered to be deleted from the array of parties.
