IN THE HIGH COURT FOR THE STATES OF PUNJAB AND HARYANA AT

CHANDIGARH C.R. No.1885 of 2016 (O&M) Date of Decision.15.03.2016 Sarpanch of Gram Panchayat and another .......Petitioners Vs.

Charanbir Singh and others ........Respondents

Present:

Mr. G.S. Sandhu, Advocate for the petitioner.

CORAM:HON'BLE MR. JUSTICE K. KANNAN 1.

Whether Reporters of local papers may be allowed to see the judgment ?

2.

To be referred to the Reporters or not ?

3.

Whether the judgment should be reported in the Digest? -.- K. KANNAN J. (ORAL) 1.

The revision petition is not competent, for objection to the executability of the decree ought to be obtained in the proceedings where there is application pending for setting aside the ex parte decree. The Executing Court will not be able to fetter its own jurisdiction for execution of the decree. If it is not stayed in collateral proceedings for setting aside the ex parte decree, the objection raised by the judgment debtor was rightly rejected and I find no reason for interference. 2.

The revision petition is dismissed.
