( Through Video Conferencing ) **** HARSIMRAN SINGH SETHI , J. (ORAL) In the present writ petition, the challenge is to the notice dated 02.12.2020 (Annexure P-22), which has been issued to the petitioner giving three months notice, on the expiry of which, he will stand premature retired.
Learnbed counsel for the petitioner argues that the record of the petitioner is such that the notice dated 02.12.2020 (P-22) for premature retirement was not at all warranted and in fact on 17.12.2020 the petitioner has filed a detailed representation explaining his record. CWP-1396-2021 -2press the challenge to the notice dated 02.12.2020 (P-22), at this stage and the prayer of the petitioner is only for deciding the representation dated 17.12.2020 (Annexure P-23) in a time bound manner by passing an appropriate speaking order.
Learned counsel for the respondents-State submits that the representation dated 17.12.2020 (Annexure P-23), filed by the petitioner, wherein, the certain grounds/objections have been raised qua the notice of retirement dated 02.12.2020 (P-22), will be considered and decided by respondent No.3 in a time bound manner by passing an appropriate speaking order. Learned State counsel further submits that the said representation will be decided within a period of one month or in any case before the expiry of three months as envisaged in the order dated 02.12.2020 (Annexure P-22) Learned counsel for the petitioner submits that in view of the statement of the learned State counsel, the grievance of the petitioner as raised in the present writ petition stands redressed, at this stage and therefore, he does not want to press this petition any further. Ordered accordingly.
It is made clear that the respondents will be bound by their statement recorded hereinbefore.
