ANIL KSHETARPAL, J (Oral) Defendant-petitioner is in revision petition against order dismissing application for permission to lead additional evidence by examining the Handwriting and Finger Print Expert. Learned trial Court after examining the facts of the case in detail, have recorded a finding that from the very beginning defendant was in the knowledge of the fact that the plaintiff has filed a suit on the basis of receipt and pronote and, therefore, the defendant ought to have examined the Handwriting and Finger Print Expert if he required in his evidence. The Court has further held that since the defendant was in knowledge of the case of the plaintiff, therefore, at this stage, when the case is fixed for arguments, application for additional evidence cannot be allowed.

Taking into consideration the aforesaid reasoning given by the learned trial Court, this Court does not find any good ground to interfere Naresh Kumar 2017.12.13 13:49 I attest to the accuracy and integrity of this document Chandigarh
