Petitioner/landlord is in revision assailing the order dated 8.11.2016 passed by Rent Controller,Amritsar whereby provisional rent for the demised shop situated Opp.Sugar Mills Gate,GT Road,Chheherta has been assessed at the rate of Rs.100/- per month. Heard learned counsel for the parties.

A perusal of the impugned order reveals that landlord had alleged non-payment of rent @ Rs.5000/- per month w.e.f. January 2015 till the passing of the order. The tenant admitted relationship of landlord and tenant. It was pleaded by him that the rate of rent was Rs.100/- per month and he was ready to pay the same for the said period, but landlord was not intentionally receiving the same.

It is not disputed that petitioner/landlord failed to produce any receipt/proof to show that the rate of rent was Rs.5000/- per month. Moreover, it is only provisional rent and the actual rent will be assessed at Rajinder Parshad Joshi 2017.11.10 12:16 I attest to the accuracy and integrity of this document

CR 1542/2017 the time of final decision on the basis of evidence led by the parties. In view of the above,finding no merit in this revision petition the same is hereby dismissed.
