-.- AMIT RAWAL J.(ORAL) The revision petition is directed against the order whereby the objection filed by the petitioner i.e. subsequent purchaser during the subsistence of the agreement to sell, in the suit for specific performance has been dismissed.
Learned counsel appearing on behalf of the petitioner specifically averred in the objection petition that the petitioner/objector has further alienated the property to third party, who has already filed separate appeal. In view of the aforementioned, no cause of action survives in favour of the petitioner in the objection petition as well as in the revision petition.
Faced with this situation and realizing that this Court is going to dismiss the revision petition with costs, learned counsel for the petitioner seeks permission of this Court for withdrawal of the revision petition. Ordered accordingly. The revision petition is dismissed as withdrawn.
