G.S.SANDHAWALIA, J. (Oral) The present application has been filed by the respondents on the ground that the revision petition has become infructuous on account of the dismissal of the suit in default on 21.05.2013. The said order has been reproduced in the application and it has been further averred that no appeal has been instituted against the said order in this Court. A photocopy of the said order has also been placed on record.

Accordingly, keeping in view the fact that the main suit has been dismissed in default and the revision stems from an order whereby, the petitioner was directed to fix ad valorem Court fees, this Court is of the opinion that the dispute in the revision petition no longer survives and the present revision petition is accordingly rendered infructuous. However, liberty is granted to the petitioner to revive in case the facts are to the contrary.
