Mr.Sanjiv Gupta,Advocate for private respondents Jaswant Singh,J.(Oral) Petitioners, who are defendants in a suit filed by respondent no.3-Thakurdwara Bagla Maruf Virdhichand Wala, challenging the sale deeds and since then the suit having been dismissed, are aggrieved by the action of Assistant Collector Ist Grade,Tosham in unnecessarily keeping the proceedings regarding mutation on the basis of sale deed pending on one pretext or the other.

It is also urged that Assistant Collector IInd Grade is competent authority to sanction the mutation and has illegally forwarded the same to Assistant Collector Ist Grade. Without issuing notice of motion, learned State Counsel on the previous date was directed to seek necessary instructions. CR 197/2015 Additional Advocate General with Mr.Raj Kumar,Tehsildar, Charkhi Dadri states that as per order dated 14.1.2015 passed by Collector,Bhiwani, Assistant Collector Ist Grade has now been vested with the powers to decide the mutation of the suit land. He further states that the proceedings regarding mutation, after notice to the parties, are now fixed for 25.2.2015 before Assistant Collector Ist Grade,Tosham and endeavour shall be made to dispose of the same in an expeditious manner.

Keeping in view the limited grounds on which this Court is inclined to interfere, this Court is satisfied that in the light of statement made by the learned State Counsel no further orders or adjudication is required in the present revision. Whatever the orders passed, the parties would be absolutely free to seek their remedy in accordance with law/provisions of Punjab Land Revenue Act.

Disposed of in the above terms.
