(ORAL) Through this petition under Article 227 of the Constitution of India prayer has been made for setting aside order dated 03.01.2018 (Annexure P-1), striking off the defence of the petitioners for non-filing of written statement and non-payment of costs, despite availing sufficient opportunities.

Heard.

Without commenting on the merits of the case, in the interest of justice, equity, good conscience and fair play, the impugned order dated 03.01.2018 (Annexure P-1) is set aside. Petitioners-defendant are permitting to file their written statement and make payment of costs imposed by the trial Court on or before 19.03.2018, subject to further costs of `10,000/- to be deposited with the District Legal Services Authority.
