The present petition has been filed under Section 482 Cr.P.C. seeking quashing of order dated 31.10.2022 passed by Judicial Magistrate Ist Class, Jalandhar whereby application under Section 311 Cr.P.C. for recalling of complainant for cross examination and leading documentary as well as oral evidence has been dismissed in complaint case under Section 138 of Negotiable Instruments Act, 1881 in case titled as Ramjit Singh Ahluwalia Vs. Rajinder Kumar in case bearing CIS No.NACT-4064-2016.

At the outset, learned counsel for the petitioner contends that the petitioner in the present case has been convicted which has rendered the present petition infructuous and seeks to withdraw the present petition. 3.
The prayer so made is allowed.
