Main cases 1.

The orders passed by the Executing Court framing an issue and posting it for trial are set aside dispensing with notice to the respondents, for the matter has already been covered through decision of this Court in Nirmal Singh Vs. Banwari Lal in C.R. No.1561 of 2012 dated 02.09.2013 that the execution shall continue further and if the judgment debtor has purchased any right from any one of the decree holders, he has to work out his own suit for partition. He is bound to surrender possession and the Court will not detain itself by entertaining any frivolous objection.
