(ORAL) Prayer in the instant petition under Section 438 Cr.P.C. has been made for grant of anticipatory bail to petitioner in a case FIR No.212 dated 07.12.2019 registered under Section 15 of the Narcotic Drugs and Psychotropic Substances, 1985 at Police Station Adampur, District Jalandhar Rural.
According to prosecution, petitioner was apprehended with conscious possession of 38 kgs of poppy husk in two bags containing 19 kgs each.
Learned counsel for the petitioner inter alia contends that FSL report has not yet been received. Therefore, it cannot be said at this stage that alleged recovery was a narcotic substance. In view of above, but without expressing any opinion on the merits of the case, the petitioner namely Binder is granted interim bail subject to furnishing personal bonds and two sureties of `2.00 lakh each, to RAVINDER SINGH 2020.01.17 09:33 I attest to the accuracy and integrity of this document
