Vide order dated 19.05.2016, notice of motion was issued on the request of counsel for the petitioners that petitioners-tenant be given sufficient time to vacate and hand over vacant possession of the demised premises to the respondent-landlord.
Learned counsel for the respondent-landlord submits that the respondent has no objection in allowing of time upto 30.06.2017 to the revision petitioners to vacate the demised premises. Learned counsel for the petitioners also accepts the proposal made by counsel for the respondent and seeks permission to withdraw the petition.
In view of request made by learned counsel for the Sachin Mehta 2016.12.22 14:24 I attest to the accuracy and authenticity of this document HIGH COURT, CHANDIGARH
CR-1993-2016 -2petitioners, this petition is dismissed as withdrawn. The revision petitioners are allowed period upto 30.06.2017 to vacate the demised premises, subject to the following terms:- (i) The petitioners-tenant will pay/deposit the entire due rent upto 31st December, 2016 within three weeks. (ii) They will keep on paying/depositing the advance rent/mesne profits of subsequent months upto 30.06.2017 on or before 7th day of each month.
(iii) They will file affidavit before the executing Court within four weeks giving details of entire payment of rent/mesne profits and undertaking to vacate and hand over the vacant possession of the demised premises to the respondent-landlord on or before 30.06.2017. In case of default of any of the above terms, the respondentlandlord will be entitled to execute the order of ejectment forthwith. ( SURINDER GUPTA ) December 20, 2016.
