The present petition has been filed by the petitioner for grant of anticipatory bail in case FIR No.001 dated 01.01.2025, registered under Section 318(4) of the BNS, at Police Station Dhar Kalan, District Pathankot. 2.

Vide order dated 20.02.2025 passed by this Court, the petitioner was granted interim bail and was directed to join investigation. 3.

Learned State counsel, on instructions from the Investigating Officer, has submitted that investigation stands completed in this case. Challan has also been presented and even charges have been framed. As such, custodial interrogation of the petitioner is not required. Given the nature of allegations and circumstances peculiar to this case, this Court is of the considered opinion that a case is made out for HARJEET KAUR 2025.11.12 15:04 I attest to the accuracy and integrity of this document

CRM-M-2427-2025 (O&M) -2allowing this petition. It is well settled that pre-trial incarceration of the petitioner cannot be replica of post sentence period. No purpose would be served by detaining the petitioner in custody. Accordingly, the petition is allowed and order dated 20.02.2025 passed by this Court granting interim bail to the petitioner is ordered to be made absolute, subject to the conditions laid down in Section 482(2), of Bharatiya Nagarik Suraksha Sanhita (BNSS) 2023 (analogous to Section 438(2) of the Code of Criminal Procedure).
