Present petition has been filed under Section 439 of the Code of Criminal Procedure (Cr.P.C.) for grant of concession of regular bail to the petitioner in case FIR No.8 dated 24.01.2019 registered under Section 22 of Narcotic Drugs and Psychotropic Substances Act, 1985 at Police station Doraha, District Ludhiana.

As per the allegations, 35 injection of Buprenorphine and 35 injection of Avil were recovered from the petitioner. Learned counsel for the petitioner prays for grant of regular bail to the petitioner on medical grounds. It is stated that petitioner is HIV positive. The medical status of the petitioner has been confirmed by the State in a status report filed by Balkar Singh, PPS, Superintendent, Central Jail, Ludhiana. It has been stated that the petitioner is HIV positive and he is undergoing treatment.

The petitioner is in custody since 24.01.2019. Investigation in the case is complete.
