The approach of the petitioner to this Court for entertaining the revision is meaningless in a situation where the defendant has not filed the written statement within time. It has been held by the Supreme Court in Salem Bar Association, Tamul Nadu Vs. Union of India (2005) 6 SCC 344 that the Court has power to extend the time for filing written statement and the prescription of outer limit of 90 days has been held to be only directory. The petitioner will approach the trial Court itself by moving an appropriate application for seeking for permission to file the written statement beyond time and set out also the reason for his inability to file written statement within time. The Court will consider the petitioner's request on the application and pass the appropriate orders.
