1. The petitioner was granted interim bail by this Court vide order dated 09.08.2023 so as to attend and to arrange for second barsi of his mother. As per the said order, the petitioner was required to surrender back on 25.8.2023 before the jail authorities. However, it appears that he did not surrender back and has absconded.
2. In order dated 31.8.2023, it had been represented by learned counsel for the petitioner that the applicant/petitioner was admitted in Sahara Multi Speciality Hospital on 25.8.2023. The State counsel was directed to verify the said assertions. Consequently, the said assertions were got verified as has also been recorded in order dated 5.10.2023. In the said order, this Court took note of the report dated 04.10.2023 of the Intelligence Officer wherein it MOHAN SINGH 2024.01.19 12:19 I attest to the accuracy and authenticity of this order/judgment
CRM-M-2269-2022 (O&M) ( 2 ) 2024:PHHC:006643 had been informed that the petitioner already stood discharged on 09.09.2023 and had even failed to appear before the trial court on 03.10.2023.
3. The aforesaid conduct clearly shows that the petitioner has intentionally absconded despite having been granted interim bail and having been specifically directed to surrender back on 25.8.2023. As such, the petitioner does not deserve any leniency in the matter of grant of bail. The petition, as such, is dismissed.
