Challenge in the present revision petition is to the impugned order dated 07.02.2017 whereby the suit was dismissed as withdrawn with permission to file a fresh suit.

Today the learned counsel for the petitioner has filed an affidavit of Teekam Singh, the legal representative of the plaintiff-petitioner, stating therein that he would be satisfied if he is permitted to continue with the suit. The said affidavit is taken on record. The same be scanned and tagged at the appropriate place.

Learned counsel for the respondents has contended that he has no objection.

In view of the above and keeping in view the aforesaid affidavit, the impugned order dated 07.02.2017 is set aside and the suit is restored to its original number and status and the petitioner is permitted to Yogesh Sharma 2025.05.19 10:10 I attest to the accuracy and authenticity of this judgment/order.

CR-1660-2017 (O&M) -2pursue the same in accordance with law. The parties shall appear before the Trial Court concerned on 01.07.2025 at 10.00 am. 5.
