PANKAJ JAIN, J. (ORAL) Present petition has been filed under Section 482 Cr.P.C. seeking directions to the official respondents for conducting fair and impartial inquiry in FIR No.83 dated 21.08.2023 registered for the offences punishable under Sections 420, 406, 120-B IPC at Police Station Sadar Moga, District Moga.

The petitioner is one of the accused thus prima facie the petitioner has no locus to seek transfer of the investigation. Apart from that she has relied upon the inquiry conducted by the police authorities only, which as per her does suggest that it is respondent No.5 who is the actual culprit and the petitioner has also filed complaint against him which is pending before the police authorities placed on record as Annexure P-2, this Court does not find any reason to interfere so far as the investigation/inquiry is concerned.

CRM-M-2454-2024 -22024:PHHC:006392 her is concerned, Mr. Tarun Aggarwal, Sr. DAG, Punjab who appears on advance notice for respondent/State submits that its a matter related to offences punishable under Sections 420, 406, 120-B IPC and if required, the petitioner shall be arrested only after complying with dictum of law laid down by the Apex Court in Arnesh Kumar vs. State of Bihar and another (2014) 8 SCC 273.
