BEDI, J (ORAL) This is a petition under Article 227 of the Constitution of India for a direction to the Presiding Officer of Matrimonial Court to decide the petition under Section 13 of the Hindu Marriage Act, filed by him against his wife within a fixed time frame claiming that the defendant-respondent has been evading adjudication of the petition under Section 13 of the Hindu Marriage Act, by repeatedly filing misc. applications. In this context, a reference has been made to the interim orders passed by the Court of Additional District Judge, Amritsar, w.e.f., May 2011 till February 2015. I have heard the learned counsel for the petitioner and gone through the orders and I am of the opinion that provisions of Section 21-B of the Hindu Marriage Act, requires a trial Court RAJ KUMAR ARORA 2015.03.31 10:34 I attest to the accuracy and integrity of this document

CR-2073-2015 (O&M) exercising powers under the Hindu Marriage Act, to try the case as expeditiously as possible and make endeavour to conclude the trial within six months from the date of service of the petition on the respondent.

This petition is disposed of with a direction that in case the petitioner moves an application under Section 21-B sub clause (b) of the Hindu Marriage Act, before the trial Court, the trial Court shall make endeavour to follow the mandate of the statute and would decide the petition filed by the petitioner within statutory period. In case of non-compliance, it will be open to the petitioner to approach this Court again.
