***** ARCHANA PURI, J. (Oral) The petitioner has invoked the jurisdiction of this court, under Article 227 of the Constitution of India, thereby making prayer for issuance of appropriate order/direction to the Civil Judge (Senior Division) (NRI Court), Jalandhar, to decide the Civil Suit No.4055 dated 03.10.2023 titled "Surjit Kaur v/s Jagtar Singh Sangha".
It is submitted by the counsel for the petitioner that the suit was filed by the petitioner, who is NRI, for seeking mandatory injunction against the defendant, to hand over the vacant possession of the property bearing No.54, Defence Colony, Jalandhar. It is further submitted that the said suit was filed in the year 2023 and is still pending at the stage of evidence of the petitioner/plaintiff. It is also submitted that lot of inconvenience is caused to the petitioner, who is NRI, on account of pendency of the said suit. In view of the submissions aforesaid, even though, with due regard to the convenience/inconvenience of the parties concerned, no such Sonu 2025.02.21 16:21 I attest to the accuracy and authenticity of this document P&HHC
CR-231-2025 direction can be given to the concerned court, to dispose of the case, in a time bound manner, while considering the age of the suit. But anyhow, learned Trial Court is hereby requested to look into the aspect of expeditious disposal of the case, in accordance with law. In view of the aforesaid terms, the revision petition is hereby disposed of.
