Narinder Singh v. Satnam Singh And ORS.
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CR No. 1676 of 2017 Date of decision : 08.03.2017 Narinder Singh ....Petitioner V/s Satnam Singh & ors.
....Respondents BEFORE : HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. Naveen Batra, Advocate for the petitioner. RAJAN GUPTA J.
Present revision petition is directed against the order passed by court below whereby it has exercised its power in allowing affidavits of PW1 & PW2 to be taken on record as additional evidence. It has been urged before the court that the order is vitiated as plaintiff availed twenty two opportunities for concluding his evidence. I find no substance in the plea. It is evident that affidavits of two witnesses were lying in the court file but were not taken on record inadvertently. The court, thus allowed both the affidavits to be taken on record treating the same as additional evidence. The order was passed in order to do substantial justice. There is, thus, no ground to interfere in revisional jurisdiction. Dismissed. March 08, 2017 (RAJAN GUPTA) Ajay JUDGE Whether speaking/reasoned:
