The learned counsel for the respondents submits that as the respondent-revision petitioner has denied the relationship of landlord and tenant, he does not press for assessment of provisional rent at this stage and will prove this fact by leading evidence before the learned Rent Controller. In view of the submissions made by learned counsel for respondent, the order dated 26.11.2014 passed by the Rent Controller, qua the petitioner is set aside making it clear that nothing observed in this order shall have any bearing at the time of decision of the petition on merits. As one of the ground in the eviction petition is personal bonafide necessity, the learned Rent Controller is directed to expedite the disposal of the case by giving short adjournments and disposed of the case preferably within one year.
