H. S. Madaan, J. (Oral) Learned counsel for the petitioner states that she be permitted to withdraw the instant petition granting liberty to the petitioner to raise all these pleas before the Trial Magistrate at appropriate time. However, she has requested that since the petitioner has to come all the way from Bombay, his personal appearance before the Trial Magistrate be exempted. Dismissed as withdrawn with liberty to raise all these pleas before the trial Court. It is directed that on petitioner filing an application before the trial Court seeking exemption from personal appearance, the same be considered sympathetically and necessary exemption be granted, allowing the petitioner to appear through his counsel. However, the trial Magistrate may direct the petitioner to appear in the Court as and when his personal appearance is found to be necessary. ( H.S.
