Through this petition, the petitioner seeks anticipatory bail in case FIR No. 124 dated 09.09.2019 registered under Sections 420, 452 and 506 IPC at Police Station Panjokhra, District Ambala. Learned counsel for the petitioner contends that the husband of the petitioner-Randhir Singh purchased a plot from Veer Parkash in the name of his wife Rajesh Rani-petitioner and constructed one room, shop and a bathroom. The husband of the petitioner borrowed the money from Gauri Shankar-father of the complainant and in lieu of that pledged 45 square yards of said plot in the favour of the Ankit Aggarwal-complainant and later on, the account had been settled.

Learned counsel for the complainant states neither the money has been returned by the husband of the petitioner nor the complainant is in possession of the plot.

     petitioner is only required to appear at the time of presentation of the challan.

I have heard the learned counsel for the parties. Keeping in view the facts and circumstances of the present case and without expressing any opinion on the merits of the case, this Court finds merit in this petition and the same is allowed. The petitioner is directed to join the investigation as and when called upon to do so and if she is sought to be arrested, she shall be released on anticipatory bail to the satisfaction of Investigating Officer/Arresting Officer, subject to the conditions as envisaged in Section 438 (2) of the Code of Criminal Procedure.

It is made clear that if pursuant to and in compliance with this order, the petitioner does not cooperate with the investigating agency, the investigating agency would be liberty to move an appropriate application for cancellation of bail.
