Present revision petition has been filed assailing the impugned order dated 10.12.2024, passed by learned Chief Judicial Magistrate, Hoshiarpur, whereby, application filed by petitioner under Section 311 read with Section 325(3) of the Code of Criminal Procedure, 1973, in FIR No.81 dated 16.03.2019, under Section 61 of the Punjab Excise Act, 1914, registered at Police Station Model Town, District Hoshiarpur, was dismissed.

After arguing for quite some time, when this Court was not inclined to accept the prayer, learned counsel, on instructions from petitioner, submits that present petition be disposed off with liberty to raise all the pleas before learned Magistrate, at appropriate stage. 3.

Ordered accordingly.
